Expressway Sales Regulations Chapter 6 Unauthorized Traffic

Article 33

利用者が料金の全部又は一部の支払いを免れることを目的として次の各号に該当する行為を行った場合は、料金を不法に免れた者として、割増金を徴収するほか刑法（明治40年法律第45号）その他の法令に違反していると認められるときは、刑事訴訟法（昭和23年法律第131号）第230条の規定により告訴又は同法第239条第1項の規定により告発します。

1. 一料金所で料金の全部若しくは一部を支払わずに、又は第25条の2第2項及び第3項に定める後日支払いの手続きを取らずに通行した場合（ただし、第18条の定めにより当社の係員が、後日、未納金として支払いを行うことを認めた場合は除きます。）
2. 二改ざん・偽造等された通行券又は車種区分証明書を当社の係員に提出、提示又は掲出した場合

5. 五改ざん・偽造等されたクレジットカード、ETCカード、又は回数券等（以下「カード等」といいます。）を使用し、又は使用しようとした場合

9. 九第19条第1項及び第25条の2第6項による支払いの督促にもかかわらず、未納金、後日支払い料金、督促手数料及び延滞金の全部又は一部を支払わない場合
10. 十供用約款第9条の規定に基づき当社の係員が行った車両の誘導及び確認その他の職務上の指示に従わなかった場合

2 供用約款第5条第1項に定める不法に免れた額は、次の各号の定めるところにより算出します。

1. 一出口料金所において、利用者が進入したインターチェンジ等を当社が認定することができない場合は、当該出口料金所から最も高額の料金となるインターチェンジ等から進入したものとした料金の額から当該出口料金所において既に支払った金額を差し引いた額

3 当社は、不正通行を防止し適正な料金を徴収することその他高速道路の適正な利用に資することを目的として、料金所又は第9条第2項第2号に定める料金所以外の箇所に設置された「ETC」の表示があるETC通信施設に画像撮影装置を設置し、通行する車両を撮影し、その画像（車両登録番号及び利用者の容貌を含みます。）を同目的に従って利用することがあります。
